This is a legal agreement between USER and MEDTELE, and USER agrees to the following terms and conditions for using MEDTELE’s offered services and hosted applications.
The expressions used in this document are MEDTELE, to refer to the firm; MEDTELEUSER, to refer to USER, an individual or organization utilizing MEDTELE hosted software and services; SYSTEM, to refer to the MEDTELE hosted platform and resources needed to offer hosted software and services to users like websites, dedicated servers, domain name, IP address range, content, bandwidth, storage, network, hosted software, and associated peripherals.
While registering to SYSTEM, USER agrees to provide true, accurate, current, and complete information about self and will promptly update the information in case of changes to keep information current, true, accurate, and complete.
USER DATA PROTECTION
USER will be fully responsible for keeping the confidentiality of all access credentials and other account information provided by MEDTELE or SYSTEM and will be fully responsible for all activities that occur under USER’s hosted platform (hosted software and services). USER agrees to immediately notify MEDTELE of any unauthorized use of user passwords and accounts or of any other security breach. MEDTELE will not be responsible for any loss or damage arising from USER’s failure to comply with these obligations.
This SYSTEM is provided as on an as-is basis by MEDTELE for the convenience of its users, and the SYSTEM and all copyrights, trademarks, and other proprietary and personal rights of the SYSTEM are the sole properties of MEDTELE. The SYSTEM is intended for use by persons 18 years of age or older.
All contents and software used in the MEDTELE SYSTEM are copyrighted, and USER agrees to fully comply with international copyrights and trademarks and other applicable laws and regulations.
TERMINATION OF SERVICES
MEDTELE reserves the right to terminate the services of any user at any time either with or without prior notice—especially if a user is found to be in violation of MEDTELE terms and conditions. MEDTELE reserves the right to refuse to offer its services to any user—and without giving any reason. USER agrees that MEDTELE will not be liable to USER or any third party for modification, suspension, or discontinuation of service.
MEDTELEs offer prepaid services, and USER’s use of services is contingent on USER’s paying in advance for such use according to current pricing of products and services. USER will make sure all dues and fees are paid on time. MEDTELE shall not be responsible for any errors or transmission failures with regard to charging and collection of funds from USER’s payment method or for any actions taken by USER’s payment method or payment provider. MEDTELE reserves the right to change the prices of its products and services at any time, and it is at the sole discretion of MEDTELE to publish such changes in prices on its websites. All payments made by USER will be subject to the agreement between USER and the provider of the payment method in addition to these terms.
MEDTELE reserves the right to modify or discontinue the SYSTEM or any part of the SYSTEM either temporarily or permanently, to change policies, and to change the terms and conditions at any time with or without prior notice to USER.
MEDTELE does not provide any kind of emergency services.
USER agrees to use SYSTEM following applicable laws of USER’s region and communications network (origination and destination), agrees not to use SYSTEM for illegal purposes, and will be fully responsible for the consequences of such illegal usage. These Terms and Conditions constitute the entire agreement between USER and MEDTELE and govern USER’s use of the SYSTEM, superseding any prior agreements between USER and MEDTELE. This agreement and the relationship between USER and MEDTELE shall be governed by the laws of the region where MEDTELE has registered its head office. Failure of MEDTELE to exercise or enforce any right or provision in this agreement shall not constitute waiver of such right or provision.
DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AS-IS AND AS-AVAILABLE BASES. MEDTELE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
MEDTELE MAKES NO WARRANTY THAT THE SYSTEM WILL MEET USER REQUIREMENTS.
THE SYSTEM WILL BE UNINTERRUPTED, TIMELY, SECURE, AND ERROR FREE.
THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SYSTEM WILL BE ACCURATE OR RELIABLE.
THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY USER THROUGH THE SYSTEM WILL MEET USER EXPECTATION.
ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
LIMITATIONS OF LIABILITY
USER EXPRESSIVELY UNDERSTANDS AND AGREES THAT MEDTELE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGE, INCLUDING BUT NOT LIMITED TO DAMAGE INVOLVING LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM:
I. THE USE OF THE SYSTEM OR THE INABILITY TO USE THE SYSTEM
II. UNAUTHORIZED ACCESS TO SYSTEM OR ANY OTHER MATTER RELATED TO SYSTEM
III. THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED, FROM MESSAGES RECEIVED, OR FROM TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SYSTEM
IV. UNAUTHORIZED ACCESS TO OR ALTERATION OF USER TRANSMISSIONS OR DATA
V. STATEMENTS BY OR CONDUCT OF ANY THIRD PARTY ON THE SYSTEM
VI. ANY OTHER MATTER RELATED TO THE SYSTEM
